New York’s vaccination mandate for nearly all adults working in public schools could go ahead as planned, the federal appeals committee ruled Monday, overturning the decision over the weekend ending this week. Until then, the mandate was suspended.

Mayor Bill de Blasio initially ordered more than 150,000 teachers and staff in the country’s largest school system to receive at least one dose of the COVID-19 vaccine by midnight tonight. That deadline was blocked for a second round Friday night by a judge at a US appeals court. A three-person jury will examine the matter on Wednesday, but appears to have passed the verdict ahead of schedule.

It is not yet clear whether the city will decide to fulfill tonight’s mandate, as originally planned, or wait for this weekend.

Vaccination mandates for city teachers and school staff have been confirmed twice by state and federal courts in recent weeks. The Ministry of Education mandate is the first stringent vaccination requirement for any group of city workers and could pave the way for a broader mandate for all city workers in the coming weeks.

Mr de Blasio said Monday that according to estimates by the municipal union representing teachers and principals, about 97 percent of principals and about 95 percent of teachers have been vaccinated, and 87 percent of non-teaching teachers have received at least one vaccination.

About 8,000 employees in the education department received vaccination doses over the weekend in anticipation of the deadline.

Union leaders, who represent the city’s teachers and principals, urged de Blasio to postpone his term, saying the school did not want to deal with staff shortages.
